Air India Crash: Victims to Receive Compensation Regardless of Fault

Ahmedabad — All passengers affected by the recent Air India plane crash in Ahmedabad are entitled to receive compensation, regardless of who was at fault for the incident. The London-bound flight, which was carrying 242 passengers, crashed moments after takeoff on June 12, 2025, resulting in a major tragedy.

According to insurance experts, the compensation process is not influenced by whether the crash was caused by pilot error, technical failure, or other systemic issues. The applicable insurance policy covers all such scenarios, ensuring that victims and their families will receive the due compensation under international aviation regulations.

The compensation framework follows the Montreal Convention, which mandates strict liability for airlines in the event of international air travel accidents. Under this convention, each passenger is entitled to receive up to 128,821 Special Drawing Rights — equivalent to about ₹1.5 crore. If negligence is proven, the compensation amount may increase, but victims remain eligible even in the absence of proven fault.

Industry estimates suggest the total insurance claim could reach $475 million. This includes approximately $125 million for the aircraft itself and $350 million in liabilities, which cover passenger compensation, third-party damages, and cargo loss. A majority of this financial burden will be handled by international reinsurers, as aviation insurance policies are typically structured to transfer most of the risk through global reinsurance arrangements.

While some families of the victims have approached legal firms in the UK in hopes of securing higher compensation, the current insurance system ensures that all affected individuals are covered. Unless deliberate wrongdoing by Air India’s management is discovered, the payout will proceed as per established international guidelines. – News Agency
